LEXINGTON ESTATES HOA
SPECIAL BUDGET MEETING
13 January 2010 @ 7:00pm, Clearfield Library
Those in Attendance: 25 Homeowners represented by one or more people, including board members.
Before start of meeting:
- HOA budget avaible for anyone who wanted one.
-- Budget Year 2010
- Sign in sheet for the purpose role taking.
Presiding and Conducting: President Jen Dicou
Called meeting to order at 7:03pm.
-Thanked everyone for coming out to the meeting, and restated the reason for this meeting (Due to not enough homeowners being present at last night’s meeting).
-Outburst by 2 homeowners.
-Jen Dicou stated that this meeting is about the 2010 budget, and then to place the budget to a vote.
-Homeowner asked why the budget vote now, when the payment due date was the 10 January 2010?
-- Answer was given using the CC&R’s.
-Homeowner had question about the HOA Insurance. (Not sure of the nature of it, due to several outbursts from the group.)
-- Questions were answered, due to the calendar year and fiscal year.
-Homeowners were starting to get out of hand.
-Meeting brought back to some kind of order.
-Homeowner asked if this budget will cover the year of 2010, and was the money collected in 2009 was expended?
-- This budget will cover January 1 through 31 December 2010.
-- The funds from 2009 were completely expended.
-Again the 2010 budget presented tonight is for 2010.
-Jen Dicou turned the floor over to Mike Scales, Treasurer.
-- Read the budget to homeowners present.
-Homeowner asked what the management does.
-- Our management company does what other HOA management companies do. They work with our landscape maintenance crew, assist in audit/tax prep, collection and disbursement of funds, enforcement of CC&R’s and working with and answering many question of homeowners.
-- We are using the lowest level of service provide by Froerer.
-Homeowner asked why we don’t manage ourselves.
-- According to our CC&R’s, it states we have to have a management company.
-Homeowner statement about the HOA and Ivory. Not sure where he was going with it and it was hard to follow due to many other comments at the same time.
-Homeowner asked if the water lines in the common area were tied to homeowner’s yards.
-- No they are not.
-Homeowner asked if our management co. lets us know how many times they patrol our neighborhood, and what the results were.
-- Yes, Froerer gives us a report.
-Homeowner asked if the Clinton city agrees with the water and electric to our common area.
-- We have a letter from Clinton city, which states they are good with current situation.
-Homeowner asked why so much for water?
-- Because we have four 2 inch water lines.
-- We have a water committee looking into changing that to bring down the bill.
-Homeowner asked why they were paying twice. Because their mortgage company was sending their dues to Ivory.
-- We don’t know why and not sure if that money is really going to Ivory. We asked them to contact their mortgage company to find out for sure. If they are we can put them in contact with Ivory to work out the problem.
-Homeowner asked if the late fees come to the HOA.
-- Yes.
-Homeowner asked why a $9.00 a month vs. $84.00 a year?
-- It takes more money to run a month to month payment.
-Homeowner asked if they could see the Insurance policy.
-- Yes, the HOA has a copy to sign out to homeowners.
-Homeowner asked if they have a say in what happen in the HOA.
-- Yes, Please come to the board meeting.
-2010 budget motioned to be place to a vote by Edward Takacs.
-Motion 2nd by Natalie Adams.
-A quick show of hands of the vote was done.
-Then all present were asked to come forward to sign a voting sheet and place a vote yes or no for the 2010 budget.
-Homeowners left after the vote, and some stayed to talk and ask question on a one on one basis.
-Everyone was asked to leave due to the room at the library closed at 8:30pm.
Closed meeting at 8:30pm.
Room straitened up and turned back over to the library, with thanks for letting us use it.

Am I the only one that wonders why the Board does not take a tape recorder to the meetings so that they have a record of what took place and so that they can review it to type of the minutes of the meeting? This is the only HOA that I have belonged to that does not make an audio recording of the meeting. Things that make you go Hmmm.

As I peruse the "proposed budget", I see no real accounting of income nor expenditures. These are not minor considerations and should be part of any legitimate budget proposal. The "proposed budget" is simply a list of numbers without an iota of substantiation or justification.
But I guess that's what we are expected to accept when we get the "lowest level of service from Froerer" for the money?
And why is it that Clinton City would be Ok with the water and electric situation? What exactly would be their role? Exactly NOTHING I keep saying. They have no legal part of, nor legal interest in, what we do as an HOA. You must be referring to the ill advised letter from Lynn Van Zant. That letter implies that the HOA is responsible for the park strip and the sidewalk which cannot possibly be true. Plus the fact that they have absolutely no role in this matter what so ever. When is it you folks on the Board are going to get that right?
I guess we can all wait now for the results of the "proxy ballots" and see how your budget fares in the coming year.
Keep trying folks perhaps one day you will achieve meaningful results on our behalf. I certainly haven't see much effort toward that end so far. You must remember your role as an HOA Board is to serve our community and I for one dno't see much of that so far.

Regarding "self management" and the assertion that we MUST have a management company. If you read really carefully, that is true unless "all owners" give written consent not to use a professional manager or a management company. So it can be done if you will simply try really really hard.
Since your intent is to expand the auhority of the Board to include the park strip and sidewalk by amending the CCR's and basically exlude getting approval from absentee owners by redefining " Resident Homeowner" why not give getting written approval from all "resident homeowners" a shot as well. You might find that most owners would agree to self manage the association and avoid the excessive cost of "getting the lowest level of service from Froerer"

If you look at the 'Proxy' ballot that the Board of Directors put on the HOA Blog, you will read that the following as the very last paragraph:
January 22, 2010 the tallies will be taken and the final counts will be posted at www.lexingtonhoaboard.blogspot.com.
Here it is, January 25, 2010 and there is nothing post to the HOA blog as to the results of the Budget election.
What is it that the Board doesn't want you to know...
Every company make some budget for various properties and this can be happened by real estate association members who take very important decisions.
